1. Introduction
These Terms and Conditions govern the use of the Minstay platform (website and mobile application), which connects users with Paying Guest (PG) accommodations and short-term stay options. By accessing our platform, you agree to be bound by these terms.
2. Eligibility
Users must be at least 18 years old to use our services. By registering or making a booking, you confirm that you are of legal age and that the information provided (including ID proof) is accurate and complete.
3. Booking & Payments
All bookings are subject to availability. Minstay acts as an aggregator. Payments must be processed through the platform or as directed by the verified partner. A booking is considered confirmed only after the successful receipt of payment or a confirmation message from our official support channel.
4. Cancellation & Refunds
Cancellation and refund policies vary depending on the specific PG owner or property manager. Users are strictly advised to review the individual property's cancellation policy before confirming a booking. In cases of dispute, Minstay will assist in mediation but the final decision regarding refunds rests with the Property Owner.
5. User Responsibilities & Conduct
Users agree to:
- Comply with the house rules set by the PG owner (e.g., curfew, guest policies).
- Maintain respectful behavior towards hosts and other residents.
- Avoid any illegal activities on the premises.
Any damage caused to the property will be the sole responsibility of the user, and they must compensate the owner directly.
6. PG Partner Responsibilities
Property owners listed on Minstay are responsible for providing accurate details regarding amenities, rent, and photos. They must ensure the safety and hygiene of the premises for all residents.
7. Limitation of Liability
Minstay acts purely as a booking intermediary. We verify properties to the best of our ability, but we are not responsible for:
- Personal disputes between the User and the Landlord.
- Loss of personal belongings or theft at the accommodation.
- Any unforeseen damages or accidents occurring during the stay.
8. Termination
We reserve the right to suspend or terminate the accounts of any user found violating these terms, engaging in fraudulent activity, or harassing other users/hosts.
9. Governing Law
These terms are governed by the laws of India. Any legal disputes arising from the use of this platform shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam.
